One way that this can be done is by analyzing the witness’s bias for the defense. In many cases, defendant includes an insurance company. These are large corporations and they routinely will use the same witnesses or the same witness providers time and again. This means a substantial portion of these witnesses’ income is derived from insurance company testimony.

These large trucks – 18-wheelers, box trucks, dump trucks and garbage trucks – make up a small fraction of vehicles on the road. And yet, they involve a disproportionate number of accidents that kill both bicyclists and pedestrians.

The problem is worse in larger cities, like West Palm Beach, where there are a growing number of cyclists and generally more pedestrians than in rural areas or highways.

As residents and taxpayers, we entrust certain powers to our government and its agents, which in turn imbues it with certain responsibilities –  chief among those being to maintain safety and order to and to render aid when necessary.

By-and-large, the government does a decent job of upholding its end of the bargain. However, when it does not, the results can be disastrous. Plaintiff was driving in a heavy snowstorm on the Atlantic City Expressway in December 2005. It was early morning. Visibility was poor. Several close-in-time and location crashes brought traffic on the highway to a grinding halt. Numerous people were seriously injured, including the plaintiff.
